By making a reservation, entering, or participating in any activity at Pro Deck Pickleball Court (“Pro Deck”), I acknowledge and agree to the following:
1. Assumption of Risk
I understand that pickleball, sports, exercise, and other activities at Pro Deck involve inherent risks, including but not limited to slips, falls, collisions, being struck by a ball or equipment, muscle or joint injuries, and other accidents that may result in injury, disability, property damage, or, in rare cases, death.
I voluntarily choose to participate and accept and assume all risks associated with my participation and use of the facility, whether known or unknown.
2. Health & Fitness
I confirm that I am physically fit and medically capable of participating in the activities I choose to undertake at Pro Deck. I am responsible for determining whether I have any health or medical condition that may affect my ability to participate safely.
3. Release & Waiver of Liability
To the fullest extent permitted by law, I release and hold harmless Pro Deck, its owners, officers, employees, coaches, contractors, partners, event organizers, and representatives from claims, demands, liabilities, damages, losses, or expenses arising from my participation in activities or use of the premises, except where liability cannot legally be waived.
4. Personal Property
I am responsible for my own personal belongings. Pro Deck is not responsible for lost, stolen, misplaced, or damaged property brought into or left within the facility, lockers, parking areas, lounges, or other premises.
5. Medical Emergencies
In the event of an accident or medical emergency, I authorize Pro Deck personnel to provide reasonable first aid and/or contact emergency medical services when deemed necessary. I understand that I am responsible for any medical, ambulance, hospital, or related expenses incurred.
6. Facility Rules & Conduct
I agree to follow all posted facility rules, safety guidelines, staff instructions, booking policies, and proper court etiquette.
Pro Deck reserves the right to refuse entry or remove any person whose conduct is unsafe, disruptive, abusive, inappropriate, or in violation of facility rules, without refund when appropriate under Pro Deck’s policies.
7. Guests & Group Bookings
If I make a reservation on behalf of other players or guests, I understand that each participant is responsible for understanding and accepting the risks associated with participation.
I agree to inform all participants included in my booking of Pro Deck’s rules, policies, and applicable waivers before participation.
8. Minors
Participants below eighteen (18) years old must be accompanied or authorized by a parent or legal guardian as required by Pro Deck.
By allowing a minor to participate, the parent or legal guardian acknowledges the risks involved and accepts responsibility for the minor’s participation, subject to applicable Philippine law.
9. Compliance With Philippine Law
This waiver shall be interpreted in accordance with the laws of the Republic of the Philippines. If any provision is determined to be invalid or unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.
